Terms of service

The terms under which the Leadflip platform is provided.

Not yet reviewed by counsel. These terms have been carried over from the previous version of this site and corrected where they described mechanics this platform does not have. Where you hold a signed agreement with us, that agreement takes precedence over this page.

1. Agreement to terms

By accessing or using Leadflip (the "Service"), operated by SKAJ Ventures GmbH, you agree to be bound by these terms. If you do not agree, do not use the Service.

2. Description of the service

Leadflip is a platform for capturing, qualifying, routing, delivering and invoicing records — commonly leads. It consists of a core and separately bookable modules. Which modules are available to an account depends on what has been agreed for it.

3. Accounts

  • You must provide accurate and complete information when creating an account.
  • You are responsible for the security of your credentials and for actions taken under them.
  • You must be at least 18 years old to use the Service.
  • One person or legal entity may hold several accounts for separate business purposes.

4. Subscription and billing

4.1 Modules and terms

The Service is provided against an agreed fee per module and period. There is currently no self-service checkout: a subscription comes about individually and is invoiced directly.

4.2 Availability of a module

A module is usable while it is enabled for your account and within its agreed period. Where a period ends or a booking is reversed, access to that module ends with it — including for automations that were built while it was available.

4.3 Usage above the agreed volume

Where a volume is agreed, usage beyond it may be charged at the rate stated in your agreement.

4.4 Refunds

Fees for a period already begun are generally non-refundable. Requests are considered case by case.

5. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of applicable law
  • Upload or transmit malicious code, spam or unsolicited communications
  • Attempt to gain unauthorised access to the Service or its systems
  • Process personal data in the Service without a lawful basis for doing so
  • Resell or redistribute the Service without authorisation

You are responsible for the lawfulness of the data you put into the Service and of the deliveries you configure out of it.

6. Data ownership

  • Your data — you retain all rights to the data you put into the Service, including record data.
  • Our service — we retain all rights to the Service, its design, its code and the technology behind it.
  • Processing — we process your data to provide the Service and as described in the privacy policy.

7. Export

You may export your data at any time using the built-in export, in CSV and XLSX. After termination we make your data available for export for 30 days before it is deleted.

8. Availability

We aim for high availability and do not guarantee uninterrupted operation. Planned maintenance is announced in advance where possible.

9. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, special or consequential damages arising from use of the Service. Liability for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act remains unaffected.

10. Termination

  • You may terminate to the end of the agreed period.
  • We may suspend or terminate an account for violation of these terms.
  • On termination, access ends and data is deleted after the export period in section 7.

11. Changes to these terms

We may modify these terms. Material changes are communicated by email or within the Service. Continued use after a change constitutes acceptance.

12. Governing law

These terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. Where you are a merchant, the place of jurisdiction is the registered seat of SKAJ Ventures GmbH.
