1. Agreement to Terms

By accessing or using Leadflip (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Leadflip is a lead generation and management platform that provides form building, CRM, lead distribution, and automation tools.

3. Account Registration

You must provide accurate and complete information when creating an account.
You are responsible for maintaining the security of your account credentials.
You must be at least 18 years old to use the Service.
One person or legal entity may maintain multiple accounts for separate business purposes.

4. Subscription and Billing

4.1 Plans

The Service offers various subscription plans with different features and usage limits. Plans may be billed monthly or annually.

4.2 Free Trial

Eligible plans may include a free trial period. At the end of the trial, your subscription will begin unless you cancel.

4.3 Payment

Payments are processed via Stripe. You authorize us to charge your payment method for the applicable subscription fees.

4.4 Overage

If you exceed your plan's usage limits (e.g., lead count, distribution volume), overage charges may apply as specified in your plan details.

4.5 Refunds

Subscription fees are generally non-refundable. Refund requests are evaluated on a case-by-case basis.

5. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or to violate any laws
Upload or transmit malicious code, spam, or unsolicited communications
Attempt to gain unauthorized access to the Service or its systems
Use the Service to collect or store data without the consent of the data subjects
Resell or redistribute the Service without authorization

6. Data Ownership

Your Data: You retain all rights to the data you upload to the Service, including lead data.
Our Service: We retain all rights to the Service, its design, code, and underlying technology.
Data Processing: We process your data solely to provide the Service and as described in our Privacy Policy.

7. Data Export

You may export your data at any time using the built-in export features (CSV export). Upon account termination, we will make your data available for export for 30 days.

8. Service Availability

We strive for high availability but do not guarantee 100% uptime. Scheduled maintenance will be communicated in advance when possible.

9. Limitation of Liability

To the maximum extent permitted by law, Leadflip shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

10. Termination

You may cancel your subscription at any time through the billing settings.
We may suspend or terminate your account for violation of these terms.
Upon termination, your access to the Service will cease and your data will be deleted after the export period.

11. Changes to Terms

We reserve the right to modify these Terms. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. Any disputes shall be resolved in the courts of the applicable jurisdiction in Germany.
